These Terms and Conditions govern your use of CostNav, a software-as-a-service platform provided by CostNav Limited (“CostNav”, “we”, “us”, “our”), a company registered in England and Wales.

By creating an account or using CostNav, you agree to be bound by these Terms. If you do not agree, you must not use the service.

You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account.

You must provide accurate and complete information when creating your account and keep this information up to date.

You must notify us immediately at bimpe@costnav.com if you become aware of any unauthorised use of your account.

New users receive a 30-day free trial of CostNav. No payment card is required to start a trial.

At the end of the trial period, you will need to subscribe to a paid plan to continue using CostNav. If you do not subscribe, your account will be restricted and you may lose access to features, though your data will be retained in line with Section 9 below.

We reserve the right to limit free trial eligibility, including refusing a further free trial to an account or business that has previously used one.

You may cancel your subscription at any time through your account settings or by contacting bimpe@costnav.com.

When you cancel, your subscription will remain active until the end of your current paid billing period. You will not be charged again after cancellation.

We do not offer refunds for partial billing periods, including if you cancel partway through a monthly or annual term. Once a payment has been made for a billing period, that payment is non-refundable, except where required by law.

This policy does not affect your statutory rights as a consumer, including any rights under the Consumer Contracts Regulations where applicable.

You retain full ownership of all recipe data, business data, customer data and any other content you input into CostNav (“Your Data”).

By using CostNav, you grant us a limited licence to access, store, process and display Your Data solely for the purpose of providing and improving the service to you. We do not sell Your Data and we do not use it to train any third-party products outside of operating CostNav.

You are responsible for ensuring that Your Data is accurate and that you have the right to input it into CostNav, including any customer information you add to the platform.

You can export Your Data at any time while your account is active. If you would like assistance exporting your data, contact bimpe@costnav.com.

Where you store personal data belonging to your own customers within CostNav, such as customer names, email addresses or order details, you are the data controller for that data. You are responsible for ensuring you have a lawful basis for processing it and that your customers are informed about how their data is used. CostNav acts only as a data processor in relation to this customer data, processing it solely to provide the service to you.

If you cancel your subscription or your account becomes inactive, we will retain Your Data for 12 months following cancellation. This allows you to reactivate your account and resume using CostNav without losing your recipes, costings and business history.

After 12 months of inactivity following cancellation, Your Data may be permanently deleted from our systems, in line with our Privacy Notice.

If you would like Your Data deleted sooner, or if you would like it retained for longer, contact us at privacy@costnav.com and we will action your request in line with your data protection rights.

CostNav, including its software, design, branding, and underlying technology, is owned by CostNav Limited and protected by intellectual property laws. Nothing in these Terms transfers any ownership of CostNav's intellectual property to you.

You retain ownership of Your Data as set out in Section 8.

We aim to keep CostNav available and operating reliably at all times, but we do not guarantee uninterrupted access. We may need to suspend access for maintenance, updates, or due to circumstances beyond our reasonable control.

We rely on third-party infrastructure providers, including DigitalOcean and Vercel, to host CostNav. While we select providers we believe to be reliable, we cannot guarantee against all possible service interruptions caused by these providers.

To the fullest extent permitted by law, CostNav Limited shall not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of CostNav, including but not limited to loss of profits, loss of business, or loss of data.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

Our total liability to you for any claim arising from your use of CostNav shall not exceed the total amount you paid us in the 12 months preceding the claim.

CostNav is a tool to support your business decisions. You remain responsible for verifying pricing, costings and any decisions made using information generated by the platform. We are not liable for business losses resulting from pricing decisions made using CostNav.

We may suspend or terminate your account if you breach these Terms, including the Acceptable Use section, or if we reasonably believe your account is being used fraudulently or unlawfully.

We will, where reasonably possible, give you notice before terminating your account and an opportunity to resolve the issue, except in cases of serious or repeated breach.

If we terminate your account without cause, for example if we discontinue the CostNav service, we will provide reasonable notice and a pro-rata refund of any subscription fees you have already paid for the period after termination.

You may terminate your account at any time in line with Section 7.

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. If we make material changes, we will notify you by email or through the CostNav platform before the changes take effect.

Continued use of CostNav after changes take effect constitutes your acceptance of the updated Terms.
